Terms of Service

1. Eligibility

Our Service is intended for users who are at least 13 years old. If you are under 13, you must have the consent and supervision of your parent or legal guardian. Parents and guardians who create accounts to generate content for children are responsible for monitoring use.

2. Account Registration and Security

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your credentials, all activities under your account, and notifying us of unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

3. What You Buy and How Billing Works

3.1 What is for sale

You pay once, per comic. There is no subscription and nothing recurring.

• The Comic — $19.99: one complete personalized comic, readable online and yours as a high-resolution download.
• The Keepsake — $39.99: the same complete comic, plus one printed comic book with your dedication, with standard shipping included wherever you are. The print is included in this price; you order it from the finished comic at no further charge.

You can build a comic and read its opening pages free, with no card, before you decide to buy. Every art style is open to every account.

3.2 Payment and purchase

• Payment is processed immediately via Stripe.
• A purchase applies to the specific comic you bought it for. It does not expire.
• Each purchased comic includes a generous allowance for redrawing images and rewriting text. Anything genuinely wrong with a comic is put right without counting against that allowance. The allowance itself covers changes of mind: it is generous, it applies to that one comic, and it is not unlimited — see 3.3.
• The allowance is the same whichever edition you buy. The Comic is the digital edition: it does not include a printed copy, and it does not carry unlimited redraws. Converting a Keepsake to The Comic — by agreement or refund — removes the printed copy and any allowance left on the comic.

3.3 Changes, reprints and refunds

Every comic is written and drawn to order for the people in it, so purchases are not refundable. What we do instead is make it right: if something is wrong with your comic, open a request on your support page and we will redraw and rewrite it with you. Where a page is genuinely wrong — a likeness that has drifted, lettering that does not match what you approved, or any mistake of ours — we fix it for as long as it takes, at no charge and without counting it against you. Every purchased comic also includes a generous allowance for changes of mind, and we will usually extend that allowance rather than leave you with a comic you are not happy with.

Working with you, within reason. Redraws and rewrites are offered in good faith to get your comic right; they are not an unlimited entitlement. We may decline to provide further redraws, rewrites or other changes where we reasonably believe the Service is being used abusively or in bad faith — for example, repeated requests that are not aimed at correcting a genuine problem, a volume of requests well beyond what finishing the comic requires, requests made to cause disruption, or requests made after a payment dispute has been raised against us. Whether use is abusive is a judgement we make at our sole discretion. This never affects our commitment to correct our own mistakes, and it does not affect any rights you have under laws that apply to you.

Nothing is sent to the printer until you have approved every page, and once a print order has been submitted it cannot be cancelled, because it is manufactured to order. Printed comic books that arrive damaged, misprinted or materially different from the pages you approved are reprinted at no charge.

Damaged, misprinted or incomplete printed copies. If your printed comic book arrives damaged, misprinted, with pages missing or out of order, or materially different from the pages you approved, tell us within 30 days of delivery by opening a request on your support page, and email clear photos of the copy you received to help@personalizedcomics.com (photos cannot be attached on the support page). Please photograph the front cover, the pages that show the problem and, for missing or out-of-order pages, the first and last pages inside the covers. Our print partner requires these photos before it will manufacture a replacement, so we cannot request one without them. Once we have reviewed them, we will have a corrected copy printed and shipped to you at no charge. A corrected copy is the remedy for a printing or delivery fault; it does not make the purchase refundable.

Before you dispute a charge. Please contact us through your support page before raising a dispute or chargeback with your bank or card issuer. We answer every request and will make a genuine printing problem right. If a dispute is raised, we will provide the card issuer with our records of your order, the pages you approved, and our correspondence with you, including any photos we requested and whether they were provided.

3.4 Printed comic orders

The first printed copy is included in The Keepsake. Additional printed copies are $19.99 each with free standard shipping. Standard delivery takes about 13 to 16 business days from the order; faster delivery options are offered when you order the print, at the price shown there. Nothing is sent to the printer until you have approved every page.

4. Service Features and Limitations

4.1 Comic Generation

Our Service uses artificial intelligence to generate personalized comic books. While we strive for high quality:

• Generated content may vary in quality
• Character consistency across pages is not guaranteed
• You may regenerate or edit any page of a comic you have purchased
• Generation times vary based on complexity and system load

4.2 Photo Uploads

When you upload photos for character creation, our AI converts them into comic book characters. Uploaded photos are processed securely and used solely for comic generation. We do not share uploaded photos with third parties.

5. Intellectual Property Rights

5.1 Our Content

All content included in the Service — website design, graphics, logos, and software — is the property of PersonalizedComics and protected by intellectual property laws.

5.2 Free Users — Personal Use Only

Comics generated with the free preview are for personal, non-commercial use only.

5.3 Paid Users — Full Commercial License

When you purchase a comic, you receive full commercial rights to it. You can:

• Sell physical or digital copies
• Distribute freely
• Modify and create derivative works
• Use commercially for any purpose
• Retain copyright to your generated comics

5.4 User-Provided Content

By submitting content (prompts, photos, descriptions), you grant us a non-exclusive, royalty-free license to use that content solely for providing the Service. We will not sell your content to third parties.

6. Acceptable Use Policy

You agree not to use our Service to:

• Generate unlawful, harmful, or objectionable content
• Violate the rights of others
• Attempt to generate inappropriate content involving minors
• Interfere with the Service or gain unauthorized access
• Use automated systems without authorization
• Reverse engineer our AI models

7. Third-Party Services

Our Service uses third-party providers including Stripe (payments), Google Firebase (hosting), Google Gemini (image generation), OpenAI (text generation), and Lulu (print fulfillment). We are not responsible for third-party practices.

8. Data Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms.

9. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not warrant that the Service will be uninterrupted, error-free, or that results will meet your expectations.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify and hold harmless PersonalizedComics from claims arising from your use of the Service, violation of these Terms, or violation of any rights of another party.

11. Termination

We may suspend or terminate your access at any time for violation of these Terms. You retain commercial rights to comics you have already purchased.

12. Governing Law

These Terms are governed by the laws of the United States. Disputes shall be resolved through binding arbitration. You waive any right to a jury trial or class action.

13. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or prominent notice. Continued use constitutes acceptance.
